As of April 18, 2023 - No update in the decision from the March 27 trial.
The Correll trial is now closed and the judge said she will render a decision within 30 days. On the evening of the completion of the Corell trial, the August 31, 2020 letter that Tom O'Connor wrote to the board in 2020 explaining the judge's ruling in our prior litigation was reviewed by the current board. This was done to provide all members with an update as best we can – as it affects ALL of us as property owners. While the facts below may or may not have be part of the Corell judgment/ruling, they need to be noted to the members at large as they were a part of the trial. It also should be noted that your current board members are attempting to continue to do what is in the best interest of caring for the lake and the surrounding areas of the lake. Your input will be valuable as these facts are re-emerging and decisions will need to be made – in a positive effort to keep the lake healthy and the community private. With this in mind, Judge Gartley stated again in the Correll case that, via her judicial review of the 2020 ruling, the association has no standing and should not exist. Since the association has accepted members by virtue of lot purchases, as per our deed covenants and association bylaws, going forward under this corporation is problematic. We, as a board, have represented the association assuming that we had the authority to do so. Judge Gartley has made it clear that we do not and will not until Jerry(Ftorkowski Enterprises) is finished selling lots. We will update everyone as we receive more information and, again, continue, as a board to provide any options moving forward to continue to care and maintain our community. please provide age and number of children attending We are currently working with Boy Scout troop 418, Nanticoke, PA - to replace the Dock at the Boat launch. Stay tuned for additional details as they become available. We have a Scout who is a grandson of a member... He gave us the IDEA that perhaps his troop can help after seeing how deteriorated the dock has been.
